A truth commission for UAP secrets
People inside the programs signed paperwork warning that revealing anything is treason, with Leavenworth or capital punishment as the penalty. Many are good people doing their duty. The film Age of Disclosure raised the need for some form of amnesty program.
The model is the Truth and Reconciliation Commission in 1990s post-apartheid South Africa. Someone confesses terrible acts, hears thank you for telling us, you are good, and the country moves on. In simplified form, that is what it was.
Use immunity for specific testimony would not cover ordinary serious crimes, which still go through the judicial process, since there is no street justice in America.
How did South Africa's commission grant amnesty?
The Truth and Reconciliation Commission was set up under a 1995 law and chaired by Archbishop Desmond Tutu. Amnesty was available only to people who made full disclosure of politically motivated acts and showed the acts were proportionate to a political objective. The commission received thousands of amnesty applications and granted a minority of them. Applicants could be questioned in public hearings, many of which were broadcast.
What does use immunity actually cover?
Use immunity bars prosecutors from using a person's compelled testimony, or evidence derived from it, against that person in a later case. The Supreme Court upheld the arrangement in Kastigar v. United States in 1972. It differs from transactional immunity, which protects against prosecution for the offense altogether. Prosecutors may still charge a witness if they can show their evidence came from an independent source.
Why is Leavenworth named as a penalty?
Fort Leavenworth in Kansas houses the United States Disciplinary Barracks, the military's only maximum-security prison. It has held service members convicted at courts-martial since the early twentieth century. The older federal penitentiary at Leavenworth, opened in 1903, also held civilians. The Disciplinary Barracks moved into a new facility in 2020.
